Description of the Service
DIYDerek is an AI-powered DIY project analysis service. You provide photos and details about a DIY project, and the Service uses artificial intelligence (Google Gemini) to generate:
- Tool and material lists
- Step-by-step instructions
- Cost estimates
- Potential issues and gotchas
- Tips and recommendations
The Service also offers quick estimates, job reviews for contractor work, and a personal tool inventory.
Account Registration
To use the Service, you must sign in with a Google account. You are responsible for:
- Maintaining the security of your account
- All activity that occurs under your account
- Ensuring your use complies with these Terms
We reserve the right to suspend or terminate accounts that violate these Terms.
Credits and Payments
Consumable Credits
The Service operates on a consumable credit system:
- Credits are purchased as in-app purchases through the Apple App Store
- Credits are consumed when you perform analyses, cost estimates, quick estimates, and job reviews
- Credit balances are displayed in the app
Pricing and Refunds
- All purchases are processed by Apple through the App Store
- Credits are non-refundable once purchased
- If you believe a purchase was made in error, contact Apple directly for refund requests as Apple handles all App Store transaction refunds
- Prices may change at any time; existing credit balances are not affected by price changes
- Credits have no monetary value and cannot be transferred, traded, or exchanged
Free Usage
New accounts may receive a limited number of free credits or analyses. We reserve the right to modify or discontinue free offerings at any time.
AI Disclaimer
The Service provides AI-generated content for informational purposes only. Important limitations:
- Not professional advice — AI-generated analyses, instructions, and cost estimates are not a substitute for professional consultation with qualified tradespeople, contractors, structural engineers, electricians, plumbers, or other licensed professionals.
- No guarantee of accuracy — AI-generated content may contain errors, inaccuracies, or omissions. Cost estimates are approximate and may not reflect actual local pricing.
- Safety is your responsibility — DIY projects can involve risks including personal injury, property damage, or code violations. Always follow local building codes, obtain necessary permits, and consult professionals for electrical, plumbing, structural, or gas work.
- No liability — We are not liable for any damage, injury, loss, or expense arising from your reliance on AI-generated content provided by the Service.
You acknowledge that you use AI-generated advice at your own risk and should independently verify all information before undertaking any DIY project.
Acceptable Use
You agree not to:
- Upload content that is illegal, harmful, threatening, abusive, or violates any third party’s rights
- Use the Service to plan or assist with illegal activities
- Attempt to reverse-engineer, decompile, or extract the source code of the Service
- Use automated scripts, bots, or scrapers to access the Service
- Circumvent rate limits, authentication, or other security measures
- Impersonate another person or misrepresent your affiliation
- Upload images that contain personally identifiable information of others without their consent
- Use the Service in any way that could damage, disable, or impair our servers or networks
We reserve the right to remove content and suspend accounts that violate these terms at our sole discretion.
Intellectual Property
Our Content
The Service, including its design, code, AI prompts, branding, and documentation, is owned by DIYDerek and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without written permission.
Your Content
You retain ownership of photos and project details you upload. By uploading content, you grant us a limited, non-exclusive licence to:
- Process your content through AI services to provide analyses
- Store your content to maintain your project history
- Display your content back to you within the app
This licence terminates when you delete your content or account.
AI-Generated Content
AI-generated analyses, instructions, and estimates are provided for your personal use. You may use this content for your own DIY projects. We make no claim of ownership over AI-generated outputs.
Service Availability
- We aim to provide reliable access to the Service but do not guarantee uninterrupted availability
- The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control
- We reserve the right to modify, suspend, or discontinue any part of the Service at any time
- Rate limits apply (currently 10 analyses per day) and may be adjusted
Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided “as is” and “as available” without warranties of any kind
- We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claim arising from the Service shall not exceed the amount you paid for credits in the 12 months preceding the claim
Indemnification
You agree to indemnify and hold harmless DIYDerek from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your reliance on AI-generated content
- Content you upload to the Service
Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
If a change materially reduces your rights, we will provide notice through the app or via email.
Termination
You may stop using the Service and delete your account at any time through the app’s settings.
We may terminate or suspend your access if you violate these Terms, with or without notice. Upon termination:
- Your right to use the Service ceases immediately
- Unused credits are forfeited and non-refundable
- If we terminate your account without cause, you may request a refund of unused purchased credits within 30 days of termination
- We will delete your data in accordance with our Privacy Policy
Dispute Resolution
Before initiating legal proceedings, both parties agree to attempt to resolve any dispute informally by contacting the other party. We will attempt to resolve any complaint within 30 days. If the dispute cannot be resolved informally, it may be escalated in accordance with the Governing Law section below.
Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer in the European Union, you retain any mandatory consumer protection rights afforded by the laws of your country of residence.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
